POPI stands for Protection of Personal Information and is similar to the GDPR in the EU. The Act came into effect on 1 July 2020 and all organisations in South Africa must be compliant with the Act as of 1 July 2021.
The aim of the Act is to give individuals more rights and protection when it comes to the collection of their personal information (any data that can be used to identify them). Any organisation that collects such data must now ensure that the information is kept securely and processed according to the new regulations.
The Act applies to all living individuals within South Africa, as well as companies, body corporates, trusts and other such entities.
If your business or organisation is based in South Africa or has a branch based in South Africa, you need to ensure that you are compliant with the POPI Act regulations. The Act applies to all personal information collected, stored and processed within the borders of South Africa.
